Terms of Service

1. Scope & Acceptance
These Terms of Service ("Terms") govern your use of the RiseKinetic platform at risekinetic.com and any related applications ("Service"), operated by [Your Full Name], located at [Your Address], Germany.
By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use RiseKinetic.
2. The Service
RiseKinetic is a habit-tracking and micro-challenge platform that helps users build positive daily routines through streaks, badges, levels, and social features. The Service is provided "as is" and may be updated, modified, or expanded at any time.
3. Account Registration
To use RiseKinetic, you must create an account using Google OAuth or email OTP verification. You agree to provide accurate information and are responsible for maintaining the security of your account credentials.
Each person may maintain only one account. You may not share your account with others or transfer it without our consent. You are responsible for all activity that occurs under your account.
4. Premium Subscription
RiseKinetic offers a free tier and a Premium subscription with additional features. Premium subscriptions are billed through Stripe on a recurring basis (monthly or annually, as selected).
Billing: Payment is charged at the beginning of each billing cycle. By subscribing, you authorize Stripe to charge your chosen payment method automatically.
Cancellation: You may cancel your Premium subscription at any time through the Settings page or by contacting support. Cancellation takes effect at the end of the current billing period — you will retain Premium access until then.
Refunds: Refunds are handled on a case-by-case basis. If you believe you have been charged in error, please contact support@risekinetic.com within 14 days of the charge. As a consumer in the EU, your statutory right of withdrawal (14-day cooling-off period) applies to your first subscription purchase.
Price changes: We may adjust subscription pricing with at least 30 days' notice. Existing subscribers will be informed via email before any price change takes effect.
5. Acceptable Use
You agree not to:
Use the Service in any way that violates applicable laws or regulations. Harass, abuse, or threaten other users through the friends or social features. Manipulate streaks, challenges, or XP through automated scripts, bots, or exploits. Attempt to gain unauthorized access to other accounts, our servers, or our database. Impersonate another person or misrepresent your identity. Use the Service to distribute spam, malware, or unwanted content.
We reserve the right to suspend or terminate accounts that violate these rules, with or without prior notice depending on the severity of the violation.
6. Intellectual Property
Your data: You retain ownership of all personal data and content you create within RiseKinetic (profile information, challenge completions, etc.). By using the Service, you grant us a limited license to store and display this data as necessary to provide the Service.
Our platform: RiseKinetic, including its design, code, branding, challenge content, badge designs, and all associated intellectual property, is owned by us and protected under applicable copyright and trademark laws. You may not copy, modify, or redistribute any part of the platform without our written consent.
7. Limitation of Liability
To the extent permitted by German law (§§ 521 ff. BGB):
Free tier: For the free version of RiseKinetic, our liability is limited to cases of intent (Vorsatz) and gross negligence (grobe Fahrlässigkeit).
Premium tier: For paid subscribers, we are additionally liable for breaches of material contractual obligations (wesentliche Vertragspflichten), limited to foreseeable, typically occurring damages.
This limitation does not apply to liability for injury to life, body, or health, nor to mandatory liability under the German Product Liability Act (Produkthaftungsgesetz).
We do not guarantee uninterrupted or error-free operation of the Service. Scheduled maintenance or unexpected outages may occur. Streak data is maintained on a best-effort basis.
8. Account Termination
By you: You can delete your account at any time through the Settings page. Deletion removes all your data permanently (profile, completions, badges, friendships) and cannot be undone.
By us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. In cases of minor violations, we will attempt to notify you and give you an opportunity to remedy the issue before termination.
9. Dispute Resolution
The European Commission provides an Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board, but are open to resolving issues directly via support@risekinetic.com.
10. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer resident in the EU, you additionally benefit from any mandatory consumer protection provisions of your country of residence.
11. Changes to These Terms
We may update these Terms from time to time. Significant changes will be communicated via email or an in-app notice at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
